1. Agreement and operator
These Terms of Service govern your access to and use of the Nexus Esports website, accounts, gaming venue features, tournaments, events, matchmaking, rankings, wallets, tickets, and related services. Nexus Esports operates from 2 Ivan Vazov Street, Plovdiv, Bulgaria and may be contacted at nexusesportscenter@gmail.com.
By creating an account, signing in, registering for an event, making a purchase, or otherwise using the services, you agree to these terms and our Privacy Policy. If you do not agree, do not use the services.
2. Eligibility and accounts
- You must be legally capable of entering this agreement. If applicable law requires parental or guardian permission, you may use the services only with that permission.
- You must provide accurate information, keep your Google or Discord sign-in account secure, and promptly notify us of unauthorized access.
- One person must not create accounts to impersonate others, evade enforcement, manipulate results, or obtain benefits unfairly.
- Usernames must follow the platform rules and must not be unlawful, deceptive, infringing, abusive, or offensive. We may require a username change where reasonably necessary.
- You remain responsible for activity performed through your account unless caused by our failure to apply reasonable security measures.
3. Acceptable use
You must use Nexus Esports lawfully and respect other players, organizers, staff, and venues. You must not:
- Cheat, collude, falsify scores, manipulate rankings, exploit bugs, evade tournament rules, or interfere with fair competition.
- Harass, threaten, discriminate against, exploit, or endanger another person.
- Upload malware, probe security, disrupt the platform, scrape it at harmful scale, bypass access controls, or access another user's account or data without authorization.
- Post content that is illegal, infringing, deceptive, sexually exploitative, or that violates another person's privacy or intellectual-property rights.
- Use the services for unauthorized commercial solicitation, fraud, money laundering, or any unlawful transaction.
4. Tournaments, events, and venues
Each tournament, event, booking, or venue may have additional published rules covering eligibility, check-in, format, scheduling, conduct, prizes, cancellations, and disputes. Those specific rules supplement these terms. If they conflict, the specific rules control for that activity unless prohibited by law.
Organizers are responsible for administering events fairly and accurately. Results may be corrected where there is clear evidence of error, cheating, rule violation, or technical failure. Schedules, formats, capacity, and venue availability may change where reasonably necessary, with notice when practicable.
5. Purchases, wallet balances, and refunds
Prices are displayed in euros unless expressly stated otherwise. Payments may be processed by Stripe and are also subject to Stripe's applicable terms. You authorize us and our payment provider to process the transaction information necessary to complete your purchase.
Platform wallet balances are service credits recorded within Nexus Esports and are not bank deposits, electronic money accounts, investments, or transferable currency unless the platform expressly provides a lawful payout feature. You must not use wallet or payment functions for unlawful transfers or chargeback abuse.
Refund and cancellation eligibility depends on the purchased service, the event or booking rules, whether performance has begun, and mandatory consumer law. Nothing in these terms excludes cancellation, withdrawal, refund, or statutory-guarantee rights that cannot lawfully be limited. Approved refunds normally return through the original payment method, subject to provider processing times.
6. User content
You retain ownership of content you submit. You grant Nexus Esports a non-exclusive, worldwide, royalty-free license to host, store, reproduce, adapt for technical formatting, display, and distribute that content only as needed to operate, secure, promote, and improve the services or the event for which it was submitted.
You confirm that you have the rights and permissions needed for submitted content. We may remove or restrict content that violates these terms, applicable law, event rules, or the rights and safety of others.
7. Our content and platform
The platform software, visual design, branding, and content supplied by Nexus Esports or its licensors are protected by intellectual-property laws. Except for rights expressly granted through the services, no ownership rights are transferred to you. You may not copy, reverse engineer, resell, or commercially exploit protected platform materials except where applicable law permits it.
8. Third-party services
The services integrate with providers such as Google, Discord, Stripe, Cloudinary, and email or hosting providers. Their services are governed by their own terms and privacy policies. We are not responsible for an independent third-party service, but this does not limit responsibility we have under applicable law for our selection or use of processors.
9. Suspension and termination
You may stop using the services at any time and may request account deletion as described in the Privacy Policy. We may warn, restrict, suspend, or terminate an account where reasonably necessary to address a material or repeated breach, security risk, fraud, non-payment, unlawful conduct, harm to users, or legal requirement.
Where appropriate, we will provide notice and an opportunity to appeal. Immediate action may be required for urgent security, safety, fraud, or legal reasons. Terms that by their nature should continue after termination, including payment obligations, intellectual-property provisions, dispute terms, and lawful record retention, will survive.
10. Availability and liability
We aim to provide reliable services but do not guarantee uninterrupted or error-free availability. Maintenance, provider outages, emergencies, game-server failures, or events outside reasonable control may affect access. We may modify or discontinue features, with reasonable notice where a change materially affects an active paid service.
To the maximum extent permitted by law, Nexus Esports is not liable for indirect or consequential losses that were not reasonably foreseeable when you agreed to these terms. We do not exclude or limit liability where doing so is unlawful, including liability for intentional misconduct, gross negligence, death or personal injury caused by negligence, fraud, or mandatory consumer rights.
11. Governing law and disputes
These terms are governed by Bulgarian law, without depriving consumers habitually resident in another country of mandatory protections available under the law of that country. Disputes may be submitted to the competent Bulgarian courts or another court available under mandatory consumer law.
12. Changes and contact
We may update these terms to reflect service, legal, security, or operational changes. We will publish the updated terms here and provide additional notice before a material change takes effect where required. Continued use after the effective date constitutes acceptance only to the extent permitted by law.
